Appeals/Administrative ReviewsAppeals/Administrative Reviews

If your application, made either in the UK or outside the UK, is refused you may have the right of appeal against the refusal decision. Whether you have the right of appeal will depend on various factors, such as the type of application and whether the application was made when you had existing leave.
If you have made a points-based system application outside the UK (Tier 1, 2, 4 or 5) you will not have the right of appeal – you will instead have the right to “administrative review”, which is a kind of appeal procedure but which is less rigorous than a true appeal.
If you do have the right of appeal, the appeal will be to the First-Tier Immigration Tribunal, which is a tribunal situated in various locations throughout the UK. Appeals can be conducted entirely on paper or with a verbal hearing in front of an Immigration Judge with witnesses and a legal representative.
We have good experience in appeals and administrative reviews, including the most complex types of case. We can advise you as to whether you do have the right of appeal and we can advise you about the strength of any appeal or administrative review.
We offer a free consultation to clients who have had a refusal decision made and who want initial advice.
